Terms of Service Agreement


The Contextual Dynamics Laboratory at Dartmouth College is conducting a study of how fitness tracker (Fitbit) data may be used to evaluate, predict, and assess various aspects of cognitive performance.  The study has been reviewed and approved by the Dartmouth Committee for the Protection of Human Subjects.  The terms “we” and “our” as used in this document refer to the Contextual Dynamics Laboratory team at Dartmouth College.  This document describes how we will use the Fitbit data we collect from you during this study, as well as your rights and responsibilities with respect to how we use your data.  Please also read the Privacy Policy for a description of what information we will collect from you during this study and how we will protect your privacy.  You must be at least 18 years of age in order to participate in this Human Intelligence Task (HIT).  If you are not 18 years of age, please do not continue.

How We Will Use Your Fitbit Data

We will use your Fitbit data to examine and explore which facets of your health and exercise history relate to your performance on the experimental tasks you perform during the remainder of this Human Intelligence Task (HIT).  We plan to present and publish our findings, along with all anonymous data we collect as part of this study.  (Any information that could be used to specifically identify you or other participants will be removed prior to publishing the data.)

Conditions of Participation

We make no representations, guarantees, or warranties of any kind with respect to this HIT.  We will protect the privacy of your data as outlined in our Privacy Policy.  However, in the event that those protections are insufficient, or fail for any reason (including errors in our implementation of those protections), there is a chance your data may be accidentally shared.  Further, we do not accept any liability or responsibility for any errors or omissions in the content of this task (and the associated websites), including any damages to your computer or related to the data we collect from you as part of this task or via your Fitbit account.  We do not represent or warrant that the information on the website is accurate, complete, reliable, useful, timely or current, or that our website will operate without interruption or error.  You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your participation in this HIT.

If you choose to participate in our study by continuing with this HIT, you do so at your own risk.  By continuing, you are signaling your agreement with and acceptance of the conditions described above.  If you do not wish to accept the conditions above, you should not continue with this HIT.
